Commercial Mediation

 What is Mediation? Mediation is a voluntary non-adversarial process whereby parties to a dispute come together in a confidential and without prejudice environment with a view to finding a settlement to their dispute.

 

Mediation is in the ascendancy. Why? Because the costs of proceeding to a full court trial are huge and, furthermore, the time and effort involved in taking matters to that extreme are considerable.

 

Mediation can be adopted in practically any form of dispute and statistically there is an 85% chance of settlement. It is also considerably more flexible that court proceedings and can produce results a court process cannot.

In relation to business matters, mediation is usually referred to as "commercial mediation" to avoid confusing it with other forms of mediation, e.g. Mediation in the workplace. Insolvency mediation, therefore, is merely a specialised area of commercial mediation.

When is the right time to mediate?

Simple - when the parties have a desire and are ready to settle the dispute.

Our fees and costs:

Mediation is cheaper than you may realise. Our services are charged by the hour and at different rates for different bands based on the value of the dispute. A mediation could cost you as little as £120. We will provide an estimate for every case on an individual basis to include all preparation time, travelling time if necessary, and other disbursements as required.

Our fees are payable equally by all parties and in advance. All our work is covered by our standard terms and conditions and we hold proper professional indemnity cover in relation to this activity.

Where the firm has acted in a mediatorial capacity, we will not act for either party in relation to the dispute subsequently without permission of the other.

There is a standard form of agreement for mediation available on application.

In addition to acting as mediator we can also act for clients in a mediation situation.
